1. Introduction

These Payment Terms & Conditions govern all financial transactions conducted on www.emptyleg.ge ("the Platform"), including purchases of banner advertising packages, operator plans, tokens, and any other paid services offered through the site.

By initiating or completing a payment through the Platform, you ("the User" or "Advertiser") agree to be bound by these Payment Terms & Conditions and all relevant sections of the Platform's main Terms & Conditions, Privacy Policy, and Banner Placement Policy.

2. Payment Gateway & Service Provider

2.1 Authorized Payment Processing

All payment transactions on Emptyleg.ge are processed through Flitt.com, an independent payment service provider regulated by the National Bank of Georgia. Flitt is certified and operates according to international payment industry standards, including PCI DSS Level 1, ensuring secure and encrypted handling of sensitive payment information. Flitt's system supports a wide range of payment methods including Visa, Mastercard, and modern wallet solutions.

2.2 No Storage of Card Data

Emptyleg.ge does not collect, store, or process any credit card information on its servers. All cardholder data is handled exclusively by Flitt and/or other authorized technical service providers like Tpay LLC, which ensures secure payment processing in accordance with:

Card scheme rules (Visa, Mastercard)
Applicable legal and regulatory requirements
PCI DSS and antifraud compliance standards

All responsibility for processing card data, card security, and transaction authentication rests solely with these payment service providers.

3. Accepted Payment Methods

Users may make payments on the Platform using:

Credit and debit cards (Visa, Mastercard)
Wallet payments (Apple Pay, Google Pay)
Other payment methods as enabled through the Flitt platform and service provider agreements

Your bank or card issuer may charge additional fees or foreign exchange costs according to their own terms.

4. Payment Obligations

4.1 Pricing and Currency

All prices displayed on the Platform are denominated in EURO (EUR) unless otherwise specified. Total payable amounts, including taxes or fees, will be shown at the checkout prior to payment confirmation.

4.2 Confirmation of Order

By confirming a payment on the Platform, you:

Acknowledge that you have read and agree to these Payment Terms.
Authorize the payment service provider to debit your selected payment method.
Agree that the payment is final and binding once processed.

5. Non-Refundability

5.1 Strictly Non-Refundable Payments

All payments made for:

Banner placement packages
Operator plans
Tokens or platform credits
Any paid feature or service on the Platform

are strictly non-refundable from the moment the payment is successfully processed.

This includes, but is not limited to:

Removal of banners due to policy violation
Account suspension or termination
Change of mind after payment
Partial use of services

5.2 Third-Party Payment Fees

If the payment processor (Flitt or any partner) charges additional processing fees, these fees are typically passed on to the User and are considered part of the total amount payable. These are not refundable once charged.

6. Responsibility for Payment Accuracy

As the paying User, you are responsible for providing accurate payment details, including card numbers, expiration dates, and billing information. Neither Emptyleg.ge nor Flitt can be held liable for errors caused by incorrect information provided by the User.

7. Authorization and Disputes

7.1 Authorization

Your payment authorization is subject to approval by your card issuer or payment provider. If a payment is not authorized, the transaction will not be processed.

7.2 Disputes

Any disputes related to payment transactions, including unauthorized charges, should first be raised with your issuing bank or card provider.

Emptyleg.ge will cooperate in dispute resolution, but ultimate authority for chargebacks or disputes rests with the bank and payment network.

8. Token Packages for Empty Leg Listings

Posting empty leg flights on the platform requires the purchase of tokens. The current packages are:

Tokens are deducted automatically per listing.
Expired tokens cannot be reused.

9. Advertisement Banner Packages

Banner placement requires separate payment. Current packages are:

For Silver, Gold, and Platinum, banners can be uploaded simultaneously or separately, but the validity is calculated from the purchase date of the package.

10. Suspension of Services for Non-Payment

Access to paid services, including advertising packages, operator accounts, and tokens, may be temporarily suspended if payment is not fully completed.

11. Liability and Indemnity

You agree to indemnify and hold harmless APOLAX Soft LLC, its affiliates, and the payment service providers (including Flitt.com and Tpay LLC) from any claim, loss, liability, or expense arising from your use of the Platform payment services or any violation of these Payment Terms & Conditions.

12. Governing Law

These Payment Terms & Conditions are governed by the laws of Georgia and any disputes arising hereunder shall be resolved in the courts of Georgia.
